A New York State Police trooper shot a driver during a traffic stop in Sodus on Wednesday evening after the driver allegedly pointed a handgun at the trooper, State Police said.

The driver was taken by Mercy Flight helicopter to Strong Memorial Hospital in Rochester and was listed in critical but stable condition. The trooper was not injured.

The stop happened at about 5:08 p.m. on Wednesday, October 28, on Preemption Road, just south of State Route 104, in the town of Sodus in Wayne County. The trooper had stopped the vehicle for traffic violations, according to State Police.

A records check then showed the driver had outstanding warrants for burglary and robbery. A Wayne County sheriff’s deputy also responded to the scene.

When the trooper went back to the vehicle to take the driver into custody, the driver refused to get out and began driving forward while the trooper was partly inside the vehicle, authorities said. During the encounter, the driver allegedly produced a handgun and pointed it at the trooper. The trooper then fired his department issued firearm, striking the driver.

The New York State Police Bureau of Criminal Investigation is investigating the shooting, with assistance from the Wayne County Sheriff’s Office. State Police have not released the driver’s identity.
